TERMS AND CONDITIONS OF USE [Effective from 22^nd August 2022]

1. PURPOSE & OBJECTIVE

• a. Rivan Sports Info Private Limited (referred to as “Rivan Sports Info”) is promoted with an objective to serve as an aggregator of Sports specialists viz, Coaches / PETs, Referees or Umpires, Sports Physios, Sports Medicine Doctors, Nutritionists, Sports Analysts and other Third Party Service Providers and Suppliers of Sports Equipment and Accessories including apparel, Courts or Ground Owners, etc., who have a bona fide intention for the benefit or users / players.

• b. The purpose of this platform is to :

• •Identify upcoming / promising players

• • Facilitate Players in identifying their current level of fitness and making it as a baseline for improvement and use baseline information in identifying player’s fitness suitable for the different sports

• • Facilitate Players in identification of PETs, Coaches, Trainers, Mentors, etc., in their near vicinity for obtaining training

• • Facilitate players in identification and use the services of Referees and/or Umpires during their internal tournaments.

• • Facilitate Players in Scheduling their Practice Sessions on their own or with the help of Coach to have a planned training.

• • Facilitate players in buying of Quality Sports Equipment & Accessories, Apparel, footwear, sports and fitness wearables, from various suppliers.

• • Facilitate players in booking available slots in Courts, Grounds, Stadia or Sports Complexes of Court or Ground Owners.

• • Facilitate players to take the services of Sports Physios and Sports Doctors and obtain advice on ways to avoid injuries and treatment, if needed.

• • Facilitate players in obtaining advice on nutritional food to help in building and maintaining physical fitness and avoiding foods and medicines not allowed under Anti-doping standards.

• • Facilitate players in using of services of Sports Analysts for identifying Strengths and Weaknesses.

• • Facilitate players in participation of Events and Tournaments.

CONTRACTUAL RELATIONSHIP

• The terms and conditions of use, govern the access or use by you (hereinafter referred to as ‘user’ or ‘subscriber’), of Applications, Website, Content, Products and Services made available by Rivan Sports Info Private Limited, a company established in India, having its registered office at 91Springboard, Mytri Square, 2-41/11, 6/2, Gachibowli (Sy. No. 35P & 36, Kothaguda), Miyapur Road, Prashanth Nagar Colony, Hyderabad – 500 084 and these terms and conditions hereinafter mentioned forms part of contractual relationship.

• A. PLEASE READ THESE TERMS AND CONDITIONS BEFORE ACCESSING OR USING THE SERVICES

• i. User or subscriber accessing and use of services constitute an agreement bound by these terms, which establish relationship between the user and Rivan Sports Info. If any of these terms are not agreeable to any of the users or subscribers, he/she shall not access or use the services. These terms and conditions expressly supersede prior written agreements with users or subscribers, if any.

• ii. Supplemental terms may apply to certain services, such as policies for a particular event, activity or promotion, and in such a case, those supplemental terms and conditions shall be communicated in connection with such services. Supplemental terms and conditions are in addition to, and shall be deemed to be part, of these terms and conditions. Supplemental terms and conditions shall prevail over these terms and conditions in the event of any conflict with respect to the applicable services.

• iii. Rivan Sports Info may Terminate these terms and conditions or services, with respect to any user or subscriber, or generally cease offering its services or deny access to the services or any portion thereof, if it has a reasonable belief that:

• • Any user or subscriber have, or is likely to, materially breach these terms and conditions;

• • Any user or subscriber do not, or is likely not to, quality, under applicable law or standards and

• B. MODIFICATIONS TO THE TERMS AND CONDITIONS OR USE AND/OR PRIVACY POLICY

• Rivan Sports Info reserves the right, at its sole discretion, to change or modify or otherwise amend the terms and conditions, or any document or information incorporated herein for complying with any legal and regulatory requirements and for any business purposes, at any time and Rivan Sports Info will post such amended, modified or changed terms and conditions on the Portal under “Terms and Conditions”. It is the responsibility of the users and subscribers to review the terms and conditions of use, any changes made thereto frequently. Any use or access of the web site or applications following the date of amendments provided in the web take effect, will signify your consent or assent to and the acceptance of any revised, modified, changed or amended Terms and Conditions of Use. Users and subscribers shall not access or use the platform or services, if they do not agree to such modified, changed, revised or amended Terms and Conditions.

• C. PRIVACY POLICY

• i. Rivan Sports Info has an established Privacy Policy and is located at “Privacy Policy” in the web site or application. Privacy Policy contains how users and subscribers may seek access to or update or edit their personal information. It also explains how the personal information is collected and used for rendering services. This Privacy Policy forms an integral part of these terms and conditions of use.

• ii. Rivan Sports Info does not share personally identifiable information of any users or subscribers with companies or other persons without obtaining permission except with the registered users, Third Party Affiliates, Business Partners, etc., and accordingly maintains confidentiality and Security of information provided on the portal. However, Rivan Sports Info shall share all such information or material in its possession or that comes to its knowledge, which is necessary or obligated to, without any prior permission, in any legal proceedings. The users undertake to review the Privacy Policy, which governs the access and usage practices of Rivan Sports Info. If any user or subscriber has objections in sharing the information, the users and subscribers shall consider not using the platform.

3. THE SERVICES

• Rivan Sports Info provides its services under this agreement. The Services constitute the provision of services on website or mobile application in the form of technology platform that enables users and subscribers to:

• a. Register and maintain their user accounts and for updating information.

• b.Take ‘Assessment’ of their fitness and compare the current level of fitness with average standard parameters identified for each sport

• c.Practice Training sessions using ‘Scheduling’ online on their own or with the help of Coach where the user opted to take the services of a PET, Coach, Trainer, or Mentor

• d.Participate in Tournaments and Events.

• e. Obtain services of PETs, Coaches, Trainers, Mentors, Referees, Umpires, Sports Physios, Sports Doctors, Sports Analysts, Nutritionists, etc., on payment

• f. Book Courts, Playgrounds or stadia of Court or Ground Owners or any Third-Party or Parties.

• g. Purchase Quality Sports Equipment and Accessories including apparel from third-parties.

• h.THIRD PARTY SERVICES

• i. Rivan Sports Info does not hold any control over the services made available or accessed by users or subscribers from third parties or their content, including branding or advertising and users and subscribers hereby acknowledge that the terms and conditions and privacy policy may be different in respect of those services. These third party beneficiaries are not parties to this contract and are not responsible for the provision or support of the services in any manner.

• ii.The platform may contain links to third-party websites and are solely for the benefit of the users and presence of these links should not under any circumstances be considered as an endorsement of the content or services of the same. Users / subscribers chose to use these links at their own risk and Rivan Sports Info has no liability attached to it.

4. USE OF SERVICES

• User Accounts & Code of Conduct:

• i. Subject to the compliance with these Terms and Conditions, Rivan Sports Info grants users or subscribers a limited license, non-exclusive, non-transferable, revocable license to access and use the Web site, Mobile Application, Platforms, Content, etc., on personal devices solely for personal use and any rights not expressly granted herein are reserved to Rivan Sports Info or its affiliates, business partners or third parties having license from Rivan Sports Info.

• ii. In order to access or use the services, registering and maintaining active personal user or subscriber account is necessary. The person must be of the age of majority to be treated as user or subscriber or where a person is below the age of majority, he/she shall register under the supervision or guidance of his/her parent or guardian, as the case may be, to be treated as a user. In the event of any person, who is under the age of majority, is registered as user under the guardianship or supervision of his/her parent or any other guardian, the terms and conditions of this contract is deemed to have been entered into between Rivan Sports Info Private Limited and the said Parent / Guardian and all the other conditions applicable to the contract apply accordingly. At the time of creation of account, Rivan Sports Info may require certain personal information, such as Name, Father’s Name or Guardian Name, Date of Birth, Age, Gender, Address, Mobile Number, Email id, Sport of Interest, etc.

• iii. Users and Subscribers undertake to provide true and correct information while creating and editing or updating their profile and they need to verify that the information is accurate and up to date. The users and subscribers are restrained to provide information that is false, fraudulent, or misleading. Further, the users and subscribers agree to indemnify any loss incurred by Rivan Sports Info due to any information or due to their action, which is false, fraudulent or misleading. Rivan Sports Info shall not be held liable for any inaccurate information provided by the users and subscribers in the portal.

• iv. The users or subscribers shall solely be responsible for maintaining confidentiality of their user name, password, credit or debit card transactions carried on online and Rivan Sports Info assumes no responsibility or liability for their improper use online. If for any reason, the users or subscribers believe that his/her login password is being, or is likely to be, used by a third party in any manner, he/she shall inform Rivan Sports Info forthwith for suspending or cancelling the user account.

• v. The users and subscribers undertake not to duplicate, download, publish, modify or distribute any information on the portal unless specifically authorised to do so by Rivan Sports Info. Copying or recreating or sublicensing or sharing of site, passwords or any downloadable information which is not in accordance with the terms of the use is defined to be a ‘Misuse’ of the platform or service and Rivan Sports Info Private Limited reserves its right to act in such manner so as to protect its loss of revenue or reputation or claim damages including stopping services or access and reporting of any abuse to relevant authorities. In the event of any Misuse is discovered or found for any purpose other than the bone fide purpose, Rivan Sports Info Private Limited reserves the right to take such action as it deems fit including stoppage of services or access and claiming damages.

• vi. The users and subscribers shall not upload, transmit, publish, post, distribute any material or information, which is obscene, vulgar, derogatory, defamatory, abusive, harmful, or do any act that is unethical, objectionable or unlawful.

• vii. Users and subscribers shall not upload, transmit, publish, post, e-mail, send SMS, either directly or indirectly, any unsolicited e-mail, bulk e-mail or any mail with a commercial motive, any SMS, for their own benefit or for the benefit of third parties without prior written consent of Rivan Sports Info.

• viii. The users shall not utilise the services in any manner so as to impair the interests or functioning of Rivan Sports Info or its web site/portal or any of its platforms or of third parties provided as link to the web sites or portals. In the event of any of these acts come to the knowledge of Rivan Sports Info, it reserves the right to block, terminate, stop access of the services and reserves right to take legal or criminal action, as it deems fit.

• ix. The users and subscribes are prohibited from doing any of the following:

• a. Interfere with or disrupt computer networks connected to Rivan Sports Info with a computer virus, or other code, files or programs intending in any manner to disrupt or interfere with the functioning of Rivan Sports Info Platform or website, or any other computer systems;

• b. Impersonate any other person or entity, or make any misrepresentation with any other person or entity;

• c.That harm minors in any way;

• d. Manipulate Identity in any manner to disguise the origin of any user information;

• e. Interfere with or disrupt with any other user, threaten, or harass any user in any manner. Further, any act that is harmful, invasive of another's privacy, hateful, disparaging, relating to money laundering or unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, blasphemous, vulgar, obscene, or racially, ethnically, or otherwise unlawful in any manner whatsoever;

• f. Impose an unreasonable or disproportionately large load on Rivan Sports Info network or infrastructure.

• g. Access data or networks not intended for unregistered users or log into server or account of any user or subscriber or Rivan Sports Info;

• h. Do any act that constitute reverse engineering, decompiling, disassembling, deciphering or otherwise attempting to derive the source code of the Site / platform or any related technology or any part thereof. Extracting data using automated processes or through any other means for a purpose not authorised to do so in writing by Rivan Sports Info.

• i. Attempt to probe, scan or test the vulnerability of any system or network or attempt to breach security or authentications measures without prior written authorisation;

• j. Any attempt to Transfer, Sublicense, Assign user or subscriber access; and

• k. That threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

• x. The user shall not infringe on any intellectual property rights of any person / entity or retain information / download any information from any computer system or otherwise with an intention to do so.

• xi. The user or subscriber undertake to test their fitness using ‘Assessment’ module only when he/she shall agree by appropriately or honestly filling ‘Physical Activity Readiness Appraisal Questionnaire’, without hiding any medical precondition. The user or subscriber undertake to take these tests with the help of a PET, Coach, Trainer, or Mentor for recording accurate results, though some of the tests can be taken independently and after suitable warmup. In the event of any user providing untrue or wrong information or takes the test by hiding any medical precondition, he/she does so at his/her own risk. Further, Rivan Sports Info reserves the right to suspend or terminate the user or subscriber, if it identifies that the information provided is inaccurate or that the inaccurate information is provided intentionally.

• xii. When a user generates fitness assessment report for the first time after using the ‘Assessment’ tool, it gives the current level of fitness, considered as baseline, and provides a comparison with that of average standard parameters. If a user undertakes reassessment subsequently after some time, the ‘Assessment’ tool generates a report giving the changed parameters, comparison with baseline and average standard parameters to indicate the level of changes and the standards to achieve.

• xiii. The user or subscriber understand and agree that these average standard parameters are based on research reports of various third-party entities or persons and are arrived at using mathematical or statistical analytical tools. The user or subscriber understand and agree that Rivan Sports Info has relied upon these reports to be accurate, considered as applicable and useful in Indian context and explicitly declare that these parameters are not independently verified by it.

• xiv. The user or subscriber understand and agree that Rivan Sports Info has taken reasonable care in identifying and capturing average standard parameters for each sport, it is likely that these parameters may not be accurate or may undergo a change with passage of time or changed circumstances. Rivan Sports Info makes every effort and reasonable care in updating these parameters.

• xv. Rivan Sports Info prohibits any kind of discrimination against age, gender, race, caste, religion, colour, marital status, disability or any other characteristics as may be protected under any law for the time being in force. Any abuse or violation of any such law, entitles Rivan Sports Info to deny access or use of services or terminate the registered user account.

• xvi. winkitsports.com and WINKIT Sports Mobile App and its related products or services that are subscribed to or used [whether it is paid or free] is meant for the purpose specified above and is meant exclusively for the use of its subscribers and registered users.

• Network Licenses, Data Networks and Devices:

• The users and subscribers are solely responsible for obtaining all licenses, consents, approvals, intellectual property rights or other rights, at their own cost, as may be required in accessing and using the platform and services. The users and subscribers are solely responsible for obtaining the data network access necessary to use the services. Network’s data and messaging usage charges or fees, as case may be, to use the services from a mobile network or internet shall be borne by the users and subscribers as per the applicable tariff and Rivan Sports Info has no responsibility on such connectivity, communication, any loss on account of transmission delays, malfunctions, etc. Users and subscribers are responsible for acquiring or updating compatible software or hardware necessary to access or use the services provided by Rivan Sports Info and it does not guarantee that the services or functions, work on any particular software or hardware on any device or devices.

ANTI-DOPING POLICY

• Rivan Sports Info strictly adheres to all activities aimed at eliminating doping. Ban on use of prohibited substances for protecting integrity and values of players, athletes and sports persons and accordingly abides by Anti-doping regulations and code of conduct, as may be amended from time to time, of the World Anti-doping Agency [WADA]. Rivan Sports Info reserves its right to stop, cancel, deny access or use of services to any user or subscriber violating these regulations or code of conduct.

BUSINESS PROMOTION

• Registered Users and subscribers, by creating a user or subscriber account, hereby agree to receive any promotion messages, by way of text SMS or E-mail as part of any promotional campaign relating to sports, or company, or for promotion of any event / tournament, of Third Party Service Providers or Suppliers, sent by Rivan Sports Info. Any user or subscriber may opt-out of receiving such text SMS or messages or E-mails and they hereby acknowledge and agree that such opt-out has the effect of impacting certain services provided on the Platform.

PAID SERVICES & PAYMENT

• Rivan Sports Info may have certain services that are available on payment basis and the users and subscribers agree to pay to access those services. Similarly, Third Party Affiliates may charge for their services. Rivan Sports Info facilitates payment using preferred payment method opted by the users or subscribers for these services or collect the charges as may be applicable for the services of the Third Parties on their behalf as an agent for collection and accordingly any payment made towards services of Third Parties shall be construed as payment made directly to those Third Parties by the users or subscribers. Rivan Sports Info shall charge a convenience fee for the services provided, either at the time of booking on the platform or upon completion of service. Any such fee or charges will be inclusive of all applicable taxes. Rivan Sports Info will send a receipt for all payments made or invoice as the case may be, for using its Platform through e-mail to users or subscribers.

• Rivan Sports Info reserves the right to revise or modify the charges for all services, at any time. Further, the users and subscribers hereby acknowledge and agree that the fee or charges applicable may increase due to geographical area or high demand. Also, the users or subscribers hereby acknowledge and agree that Rivan Sports Info may, at its discretion, provide certain discounts or promotional offers, for a continuous period or for a limited period, that may result in differential charges or fee for its services or the services provided by Third Parties.

• Any fee or charges or payment towards services shall be final and non-refundable, unless it is on account of any major failure of services as determined by law or otherwise determined by Rivan Sports Info on account of minor failures, at its discretion.

• winkitsports.com is a site and WINKIT Mobile App, that have free access to public and Rivan Sports Info Private Limited assumes no liability for the responses the users receive or the quality, though it makes every effort to provide appropriate response. Every user needs to conduct his/her own background checks on the bona fides of all the responses they receive.

• The users give Rivan Sports Info permission to use the information provided in the Platform without any additional compensation and use the information for bona fide benefit of the users and the company, which may be in the form of suggestions or recommendations.

Pricing Range

• a. Coaches / Trainers:

• Pricing of Coach / Trainer Fee depends on various factors such as – Sport, Location (City, Town or Village), Coach Level, Coach Experience, Level of Coaching from Basic, Intermediate, Advanced to Professional (personalised). Accordingly, the price may range from Rs. 1,000 per month to Rs. 25,000 per month. Users have the choice of selecting the coach / trainer considering the above factors and their budget.

• b. Sports Venues Booking:

• Pricing of Sports Venues depend primarily on the location, sport and the venue facilities. Details of sport, facilities, terms and conditions of use of facilities, availability of slots is listed by the venue owners and users have to abide by their terms and conditions while using the venue. Pricing of sports venues may range from Rs. 400 per slot to Rs. 5,000 depending on the sport and the slot.

• c. Sports Medicine Doctors:

• Typically, the Consultation Fee for Appointment Charged by the Doctors range from Rs. 500 to Rs. 2,000.

• d. Physiotherapists:

• Sports Physios’ fee depends on the whether the player requires mere consultation or certain number of sessions. Consultation Fee ranges from Rs. 500 to Rs. 2,000. Additional charges will be charged towards physiotherapy sessions depending on the nature of injury and the number of days of treatment required.

• e. Nutritionists:

• Nutritionists typically charge their consultation fee of Rs. 1,000 to Rs. 5,000 depending on the location.

• f. Sports Analysts:

• Sports Analysts fee depends on factors like sport, location, recording of off-field or live analytics and accordingly it ranges from Rs. 5,000 to Rs. 25,000.

• g. Umpire / Referee:

• Umpire or Referee charges vary for each sport and it ranges from Rs. 3,000 to Rs. 25,000 per game.

CANCELLATION AND REFUND POLICY

• a. Booking of Sports Venues, Appointment with Nutritionists, Physiotherapists and Sports Doctors:

• i. Users of the Platform can choose to cancel their service bookings related to Sports Venues, Appointment with Nutritionists, Physiotherapists, Sports Doctors at least 24 hours prior to appointed slot time. In such a case, user is entitled to a refund of 60% of the booking fee.

• ii. It may happen that the date of the booking and date of appointed slot time falls on the same date. In such a case, user is entitled to a refund of 40% of the booking fee, subject to the condition that time gap between time of booking and appointed time of the slot is equal to or more than 6 hours.

• iii. Users shall not be eligible to any refund in respect of any cancellation other than those specified cases in clause (i) and (ii) specified above.

• iv. User is entitled to full refund if the cancellation is from the service provider due to unavoidable or unforeseen circumstances.

• b. Services of Coach, Sports Analysts, Umpire or Referee:

• i. Users of the Platform can choose to cancel service bookings related to Coach, Sports Analyst, Umpire or Referee at least 24 hours prior to the commencement of their Slot time. In such a case, user shall be eligible to a refund of 75% of the Service Charges paid. Users are not eligible for any refund or pro rata refund once the slot commences.

• ii. Users shall not be eligible to any refund, if they cancel the booking less than 24 hours of the slot time.

• iii. User is entitled to full refund if the cancellation is from the service provider due to unavoidable or unforeseen circumstances.

REFUND TIMELINES

• A Refund will be initiated upon cancellation request and will be processed by the Company within 5 working days. Once Refund is processed you can expect the refund to be credited to the source account within 3 working days.

• • It may be noted that Bank Holidays are excluded from calculation of working days.

• • Refund will be processed to the original payment method used for bookings.

• • If the refund is issued to credit card account, card provider may take additional time to update the statement and the users are requested to check credit card statements to confirm the receipt of refund.

• • If the user intends to cancel the booking, it is requested to check and update their bank account details for processing the refunds successfully.

LIMITATION OF LIABILITY

• Rivan Sports Info merely acts as a facilitator and provides online Platform to the users for availing services of registered service providers or equipment/accessories or apparel of registered Suppliers. All the information pertaining to products and services on the platform are as per the information provided by the Product/Equipment/Service Providers to Rivan Sports Info. This information is for reference purposes only. Any discrepancy that exists between the information on the Platform shall be raised by the user with the product/equipment/service providers directly and need to be resolved between the registered user and the product/equipment/service provider. Rivan Sports Info holds no responsibility in the process of resolution and shall not take any liability for such discrepancies in the information.

• In any event, Rivan Sports Info liability for a failure to comply with any of the terms, or breach of any condition, warranty, is limited to the extent of the cost of supply of relevant services, or the payment for the cost of resupplying the product/equipment/service through the Rivan Sports Info Platforms. Rivan Sports Info is not liable for any indirect, incidental, special, exemplary, punitive or consequential damages, including loss of profit, loss of data, personal injury resulting from use of product/equipment/services of third parties or on placing reliance on the services of a third parties, even if the products, equipment or services are procured, acquired or transacted through Rivan Sports Info Platforms.

• The user consents that in the event of any technical reasons such as network downtime, disconnection with third party platforms or similar failures, Rivan Sports Info’s obligation shall be limited to the amount of advance or amount received, if any, from the users. Such refunds shall fully discharge Rivan Sports Info from all liabilities with respect to that transaction. Additional liabilities, if any shall be borne by the user.

• In no event shall Rivan Sports Info be liable for any direct, indirect, punitive, incidental, special or consequential damages, or damages like damages for loss of use, data or profits, arising out of or in any way connected with the user or performance of this Website or any other sales channels.

INDEMINITY

• The user agrees to indemnify, defend, and hold harmless Rivan Sports Info and its respective officers, directors, employees, lawful successors or assignees from or against any losses, liabilities, claims, damages, costs and expenses including legal fees and disbursements in connection therewith and interest chargeable thereon asserted against or incurred by such indemnified person, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty, or non-performance of any covenant.

FORCE MAJEURE

• There can be exceptional circumstances where Rivan Sports Info / or the Service Providers may be unable to honour providing the services or products due to various reasons such as the Act of God, labour unrest, insolvency, terrorist activity, floods, hurricanes or famines, a pandemic or an epidemic, business exigencies, or government policy, or any technical or operational issue or for reasons beyond the control of Rivan Sports Info or of product or service providers. If Rivan Sports Info has advance information or knowledge of any such situations where the service or product delivery may not happen, it will make its best efforts to provide a similar alternative to the users or refund the money, fee or advance after deducting applicable charges, if supported and refunded by the respective service providers or suppliers. The user agrees and consents that Rivan Sports Info, being merely a facilitator of the services or products booked, cannot be held responsible for any such Force Majeure circumstances. The user has to contact the Service Provider or Supplier directly for any further resolutions or refunds.

• Notwithstanding anything contained in these terms, Rivan Sports Info shall not be deemed to be in default of or is responsible for delays, failures in performance resulting from acts that are beyond the reasonable control of Rivan Sports Info.

SEVERABILITY

• If any provision of this user agreement is determined to be invalid or unenforceable in whole or part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of the provisions of this Agreement shall continue to be in full force or effect.

DISCLAMER

• While Rivan Sports Info has taken reasonable care in identifying and building fitness ‘Assessment’ tool by providing average standard parameters for each sport, it is likely that these parameters may not be accurate or may undergo a change with passage of time or changed circumstances. Rivan Sports Info makes every effort and reasonable care in updating these parameters, it shall not be held liable for the differences or variances if any in Indian context, or inaccuracies or errors in the parameters due to mathematical or statistical analytical tools used by the third parties in arriving at the standard parameters, or for the delay in updating of these parameters due to changed circumstances or passage of time.

DISPUTE RESOLUTION

• Any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the services or these terms and conditions, validity, applicability, construction, or its enforceability or in relation to the services provided by third party service provider shall be resolved by making a complaint to Rivan Sports Info. Rivan Sports Info shall resolve the dispute within a reasonable time not later than 5 working days or it shall refund where such dispute relates in relation to any products or services. However, user shall be obliged to raise any dispute or complaint as it arises with the services or services provided by third parties within 48 hours or within such reasonable time as may be practicable. If no complaint is received by Rivan Sports Info within a reasonable time or within 48 hours from dispute, Rivan Sports Info is under no obligation, and it shall be at the sole discretion of Rivan Sports Info whether to resolve the dispute or not.

• Where Rivan Sports Info is unable to resolve the dispute, the case may be referred to an arbitrator, to be nominated by the parties with mutual consent and the decision of the arbitrator shall be final and binding. Any proceedings, including documents or submissions made by the parties, correspondence between a mediator, and any order or award issued by the arbitrator shall remain strictly confidential and shall not be disclosed to any third parties without the written consent from the other party unless such disclosure to third parties is required in the context of the mediation and arbitration proceedings.

JURISDICTION

• This agreement is subject to interpretation as per the Laws of India and the parties shall refer any unresolved disputes to the exclusive jurisdiction of courts in Hyderabad.

OTHER PROVISIONS

• The Trademarks, logos and service marks displayed on the website, mobile application, platform, etc., are the exclusive property of Rivan Sports Info or that of third-party suppliers. The users or subscribers are not permitted to use them without the prior consent of Rivan Sports Info or the third party, as may be applicable.

• All material on this website, mobile application, platform, etc., including images, illustrations, video clips are protected by copyrights, trademarks and other intellectual property rights that are owned or controlled by Rivan Sports Info. These are subject to download or print restrictions, including the restriction on reproduction, distribution or display or transmission restrictions or limitations, unless specifically expressly grated by Rivan Sports Info.
